2009 xDrive30i Fuel Filter ID
I know that isn't the actual filter. Yet when I try searches at FCP, Pelican, eEuro, ECS & Turner I get nothing. The ONLY place I was able to locate a possible correct part number was thebmwminipartsstore.
Notice it only lists up to 04/02. And when I take that same part number, 13321709535, back to realoem it tells me it was superseded by 16126754016, which then lists e39, e38 & e53. Fcp it tells me this filter does not fit a 2009 e70 3.0. Wth? I suppose I can always wait until Monday and call my local BMW dealer...

A 2009 should not need a filter. Are you shooting repair part darts or just trying to be proactive?
The filter looks close to as big as the e53 and I changed one at 185,000 miles and though it was very black it wasn't flow restricted at all prob half its life left. Just a tiny o-ring was actually worn out. As far as I'm aware the fuel filters on all modern BMW are effectively lifetime filters. People replace on e53 when the o-ring fails and you lose fuel pressure. I wonder if a similar situation goes on in the e70.

But to finish my previous thought process, I was looking to see if there was a similar siphon jet on this e70, like in the e53, that may be causing this issue. From what I can tell from the description in realoem there is not a siphon jet. Unless I simply need a more detailed image of the fuel supply system for part number 16117195469.

If you add a couple gallons of fuel and the symptoms go away = siphon jet.
Wife's car had similar problems and it was the FPR. Hook up a fuel pressure gauge and leave overnight. It should still have pressure. Use the hidden OBC menu to read the two fuel gauges. I dont know the exact values for e70 but will be similar to e53 where the right level will hit some value and stay there. If right drops below that level (1.4L for e53), that means the siphon jet is not working. It looks like there is a different setup with e70 where there is a hose from the right to left presumable from the FPR prob built right into the pump assembly. I opened up the left side a little bit and key on the gas sprayed out like a morning pee. (o-ring failure)

Wanted to follow up on this; We didn't have the luxury of time to just put a few gallons in and wait/test but we did fill up the vehicle and upon filling this particular starting issue did subside.
We don't let our vehicle's tanks get below half a tank in the winter, in case of snow storm, etc., so it may be some time before the symptoms are exhibited again. That is unless I get the time to replace this part before Winter is over.

the problem with the "not lower 1/2 tank" is you likely only have access to 2/3 of your fuel. (Can actually increase your odds of getting stranded: I know this first hand because my wife always filled up before 1/3 tank and let me discover that I couldn't get close to the low fuel light).
You can determine if the siphon jet is broken using the hidden menu and drive down to about 27L remaining. If the right side drops below 1; eg. You get a reading like 250008 (25.0 left 0.8 right) you've confirmed the siphon not working and at least you know dont get below about 30L or 1/3 of a tank. Happenstance I had to fix each of mine in the dead of winter in an unheated garage and it wasn't a terrible job I did the o-ring fix in my basement.

Once you confirm you can be sure that's it is the siphon jet and just be careful to not go below 1/3 of a tank and if you get close pull up test six and if right tank drops below 1L get gas immediately.
