That would be up to a jury. I would not want to bet either way. Please note that in civil cases the criteria, I believe, is not "beyond a reasonable doubt," but, "preponderance of evidence." |

I have premium sound, navigation, rear seat entertainment, snap in adapter, the ipod usb/3.5 plug, and the adapter so I am able to play audio fine from my iPhone/iPod on my 09 X5.
I want to know if there is a way I could play videos from my iPhone/iPod on the BMW Navigation screen? I don't mind controlling it thru the i-drive or the ipod, but I want a simple install like the OEM audio setup as I will use the videos rarely. Anyone know what will work for me?

You need only look at the first page of this very thread to find the answer. What you need and how you do it is described in detail. You didnt even have to do a search which would have shown you several topics on your query, just read this thread! I just installed the invision rear seat entertainment, drop down screen for the third row, an IPOD VIDEO interface and a FLIR, all of which is tied in to the OEM screen. I can watch video from three different sources on these screens independently, watch one source on all for screens or any combo in between. Happy to answer any q's you may have. |

Which iPod Video interface did you use? Are you able to control the ipod from the i-drive or what? Lastly, are you able to view the video while driving, or does it stop? sorry for so many questions..

With regard to the Invision Rear entertainment system, (my second of three video sources), I can actually view the Invision menu on the OEM screen and make selections while viewing the OEM screen thru the Invision remote or watch the selections being made from someone in the back thru the actual invision controls on the monitors. Each of the two Invision monitors allows for an IPOD plug in, and other video sources, including games, playstation etc, thru either a USB port or standard 3 prong video portal (all in addition to the DVD slot for each). If I plug the IPOD into the invision system then I can actually see the IPOD menu on the OEM screen but that doesnt really give me any benefit. Each of the 3 external video sources connected via the BMW56 CAN are accessed thru the I-Drive using either the center console MENU button or steering wheel controls. I can also control the full screen or split screen of these sources thru the I-drive menu and steering wheel buttons. Hope this helps. Happy to answer any other q's you may have. |

Two entirely different issues. In the case of a statute under criminal procedure, merely having it on while driving is in of itself a violation subject to penalty. The proof of intentionally having it on while driving as Berniec states would have to be beyond a reasonable doubt. In the case of civil matters, where there was an accident and resultant harm for which a civil action was brought, the issue is one of negligence, proven as you correctly state by a preponderence of the evidence. Merely having it on would not, of itself, lead to liability. There would have to be a showing of driver negligence where the screen distracted the driver and therefore the driver was negligent by becoming distracted. It is the distraction which is negligent, not the mere fact that a video source was on. There has to be a causal relationship. There is no strict liability under civil procedure for merely having it on, as I read a version of the pending HB 960. Also as a HB (House Bill) that would be a bill introduced to the House for consideration. it is not yet the law of the land. I do not know if it has since been been passed. I know this was one of a series of Driver Distraction legislation being considered. It may have very well been passed, my rather fast and superficial research this morning however did not find it as an actual passed statute. Perhaps you know more of this? I would like to read the actual statute if it has been passed. |

I do not find the Invision system to be that much a space hog. |
