I did get a reckless driving. I wish I could simply pay the ticket but I received a court date and nothing else. I'm not trying to say I'm in the right here, but it's a blurry situation. The motorcyclist was speeding and not paying attention, if he had been he would have seen the other driver waving me on from far away and accommodated my pass.

Also I did speak to my attorney who recommended I go alone and explain my side. He doesn't seem to think it's a big deal, being that it's my first citation of this sort and I have a clean driving record.

I hear you...no barrister nor cop fan, but cops can sort of exceed the speed limit
when they want to/can. Yes, he probably wasn't paying attention. None of us knows
the visual situation at the time. I am glad you didn't run the m'cyclist off the road
or T-bone him, cop or plain citizen. The CT reckless driving law(s) and interpertations
are a tad vague. Good Luck.

My $.02 of free legal advice is the same as you got above. Go alone, be apologetic, admit to being in the wrong, and flaunt your clean driving record. Blaming the cop won't work, even if he did contribute somewhat to making it a closer call than it should have been. The operative word here is 'contribute' and in a contributory negligence case, you kinda figure out how much of a part each party played, and assess damages accordingly. Breaking the double yellow and passing in a no passing zone is what, 85% of the problem here? 90%? I dunno. So I would eat some crow, bring your checkbook, and throw yourself upon the mercy of the court (and your insurance company).

Glad no one was hurt!

The good thing is that there was no accident or else, it could have been worse. This is a good lesson to learn and should never pass the no passing zone.

I hope every thing will work out well when you see the Judge and good luck.

Not sure how the courts are where you live.. But if I were you, I would not take the chance of fighting this by yourself.

I faced a Wreckless driving offense myself in NYC a year or 2 ago. I went with a lawyer and it worked out for the best. The Judge agreed to knock it down to a lesser charge but still a driving offense. MY lawyer suggested something else and the Judge accepted it. I walked away paying a fine for a non driving offense and no points on my License.

The thing about courts are, at least here in NYC anyway, you don't really get to explain what happened. The Judge just goes by what the officer wrote on the ticket.

So outcome of this was a speeding ticket, maybe I got off easy but thank God it's over with, the stress of the court date was far worse than the actual appearance.

On another note, absolutely shocked at what people wear to court these days. I was one out of about 3 people, out of at least 60 who even wore a tie. People had everything from baggy torn up jeans to pajama bottoms on. The judge or prosecutor never even batted an eye.

. If you have a traffic lawyer in NYC, they know the law better and can at least recommend a lesser punishment.
