As far as quality goes, its just not US built cars, its general!I bought a brand new M3-E30 in 1988 ,always garage kept and 22 years on,not a trace of rust on it anywhere, leather stood up well and the electrics faultless. In contrast I look underneath my X (also garage kept)and I am shocked !Rusty shafts,bolts,screws....!They just dont make cars like they used to!

Light switch peeling is no big deal, but its the 2nd time I heard about it on a Bmw?
You just need to ask the VAG guys with the A4s,A6,etc.....they have had really bad issues with peeling trim on door handles, centre console and most plastic interior trims for 10 years or more....!
I know ,I resprayed lots of them!

Elevate it, by elevating the damages I'm asking for, that will be above and beyond what are allowed in small claims in CA, by dismissing the small claims suit, or letting the small-claims suit play out and then filing suit in Superior Court with additional causes of action. Unjust enrichment, etc. There are a plethora of arguments here. At least 7 or 8 that will pass tests and are standardly used in these types of defective product cases.

Wait, you will elevate it to superior court AND THEN file a suit?? So what exactly are you elevating before it is a suit?

How can it be elevated before I file suit? The suit would be filed in Superior Court...I meant to say, I would refile a different claim in Superior Court, and withdraw the case in small-claims.

Uh oh. "certainly"... an attorney (of some kind) certainly named as a plaintiff? that will scare them. They will just write a check for $50k more than you want just to avoid having an attorney named as a plantiff

Why would it scare them, they're sued each and every day. They won't care. It's the cost of doing business. Business are not afraid of being sued. Said attorney (of some kind) is well equipped and is lead counsel for companies larger than BMWNA. That says nothing, but to say that corporate litigation is said attorney's focal point and said attorney would only be an asset in small claims court, where attorneys are not allowed. That greatly increases the odds of a judgement against the defendant. It's a factually based case, with written records, from the dealership of what they will do, when they will do it, of which they have not done. There's little to argue, and we want little in return, except for what was contractually promised to us.

Again, confused.. you are writing them a letter torrrow, or filing a suit?

-writing a demand letter with a deadline, deadline passes, filing suit in small-claims, unless between now and the hearing another major issue takes place that they refuse to fix. Then would withdraw case from small-claims, and file in Superior, or wait for hearing in small claims, and then file in Superior for a different cause of action.

You don't 'file' a letter to the BMW, the dealer, the SA, their kids, neighbors and dogs... you send them a letter.

Thanks for the education. Look at the time of night when the letter was written. A few beers after a long day... resulted in a poorly written e-mail. I'll grant you that in full.

I'd sooner get my legal advice from the internet.

Where do you think most attorneys perform their research? What do you consider West Law to be? Don't tell me you use their CDs or their books.

Let us know when you file. Whatever you file. If you file. or whatever..
I'll be sure to let you know, don't worry.

The first time I noticed there was some deterioration in my X5 light knob, I didn't even bother about it but after I have seen the same issues here in the forum, i think I've read like 6-7 members with same problems (with one even posting a picture of it..same as what happening to mine), then I realized I have to let my SA do something about it. I am more bothered with the finishes in the steering wheel, it's peeling bad and it's ugly...I mean for a 56K car, you'll get these unpleasant things in your car?

the burning question remains... are the replacement parts made of different material/finish so it won't happen again? I can't really tell. Anyone with a recent model that this is happening to? 2010 models?

That would mean admitting they were wrong, then everyone would jump on the bandwagon. Its like the burnt pixel "goodwill" replacement program...not advertised or guaranteed, making it easier to say yes or no on a case-by-case basis. It seems that if you have regularly serviced your vehicle at the dealership, they've essentially made plenty of money off you, so they'll go ahead with most replacements. if you take your vehicle to an indy or do it yourself, guess what they're answer will most likely be.

I'm having the switch replaced on Monday as well as a leaking power steering pump. I will let you know what they replace it with.

Ok. I had my switch replaced yesterday with the exact same type of switch (i.e. does not have the aluminium protectors). I just told my wife never to touch it and leave it in "auto".

just got my SAV yesterday. Per dealership, the lamp switch replacement was denied (but approved the steering wheel issue). The dealer had someone checked the said switch (apparently this person were doing miscellaneous repairs i.e. trims , etc) and was told by my SA that he did something to hide the white stuff (deteriorating part of the knob) - in other words, did some "improvise". Whoa, for a 56K car, all they can do was made some cosmetic repair, lol (at least the dealer had made something free of charge after the BMWNA denied authorization to replace the whole switch knob).
