You might end up with some extra horsepower if they have to bore the cylinders because of scoring.

I don't think the dealership will do anything shady. They are getting paid to do the work and have no incentive to do anything other than do it right. I would keep track of the progress, ask them what they found wrong and what they did about it. The BMW way is new parts so I don't know if oversize pistons or crank bearings are even available. If they will be using a rebuilt short block will you have the 5 year of the supplier or the one year warranty of the dealer? If outside supplier will you know what they did to rebuild the short block you got? I wouldn't do any performance mods that voids the warranty now or could be used to do so down the road any mods during the warranty period. I don't remember what engine you have but if it is a 4.6 maybe you can could upgrade to the stroked 4.8 version.

So, Now what about the catalytic converters? They hydro locked your motor with oil..... Which they did! Indicated by the smoke in your exhaust, then a seized motor caused "most likely" by a bent or broken rod. Your cats are probably swimming in oil. And damage to your 02's has probably happened too. You "unfortunately" are dealing with more than just an engine swap. Your issue is, you can't prove anything cause you cant see the oil in your cats, or on your 02's. I hope you thought this through..... I would have tried to settle for money and let them deal with the remains of their mistake.

Bavarian Auto Recycling is selling off all the Sonnen equipment (used for engine rebuilds). this stuff was for sale quite a while ago so I am not sure they are still doing the rebuilds.
GL though.

There is a lot to be said for getting the X back that you bought. I don't think you made a mistake and the purchase prices they offered were not realistic to your situation. Now that they are going to rebuild your engine just ask them if they have checked downstream of the engine such as the above and verified the oil didn't do further damage. Have they provided anything for you to drive while the X is in the hospital?
