That may be true. However, I think that I should be able to have a say at this point. There are no cars available that I would want. I have, along with the dealer, checked into this already. A custom ordered 550i or 750i would be mid march delivery. We are planning a trip to Europe likely in May/June. This would be a preferrable option.

I don't want another X5M. I have been contemplating that for awhile. I just wouldn't feel comfortable with another one. Especially after hearing about another engine malfunction with a 2011.

So, the car is clearly a lemon under KY law. Either they take it back, or we proceed with litigation.

While I understand that higher ups may be out over the holiday, this decision could have been made earlier and this resolved. Yet, next week will begin month four. Car is still malfunctioning. I just want out.

I have had this message once, under hard acceleration, about a month ago, after owning this vehicle since Sept 2009, and definitely driving her hard on occasion.

2010 X5 M, very early build (first one in Dallas). About 16,000 miles. The message disappeared the next time I turned on, and haven't seen it since. I did not notice any actual power failure.

I have had a multitude of issues with this vehicle though.... it has been in the shop probably for a total of 3 weeks, with all kinds of problems.

But, I figure that is the price of having such a high performance vehicle and a BMW. The quality of German engineering is not quite as good (from a reliability point of view) as the Germans think it is. All my acquaintances who own BMWs tend to agree with me.

I intend to trade in for a 2012 M5 as soon as I can. And I expect major issues with the new M5 too.....

BMWNA and BMWFS have agreed to take the vehicle back as of this afternoon. They have not offered to refund my payments, but wanted me to pay a mileage usage charge on top of my lease payments. I said no, unless the payments were refunded (which includes an usage charge) that I thought a mileage fee on top was unreasonable. They have agreed to waive the usage charge. Basically I walk away without anything out of pocket.

My only concern is how others have said they had payments refunded back with a buy back. BMWNA and BMWFS are, through the dealer rep, calling this a trade assist even though I am not getting another vehicle. Thoughts? Advice? Call put to my BMWNA rep today has been unanswered.

Glad you are at least getting some formal resolution. Sorry it was so painful for you. Remind me to ask you for your vin if I ever consider getting a used 2010 X5M...

Please let us know your thoughts on the pepper turbo when ever you get it compared to the M.

no refund on mine, it was all wiped clear and i started over. the car was sold to me with no mark up. so far the 2011 has been a 100% better and different vehicle. again, Gl with this mess

i have different seats this time so that could the difference in the ride im feeling but that appears to be better. the only other thing that comes to my mind is that the exhaust note is better than my first M (i notice it more often atleast.) It cant seem to make it over 12mpg? maybe its the break-in period but in the mode i use right now i was previously getting 15*mpg
