3). Retain legal counsel.

I am beyond mad. I am likely through with BMW at this point. Cannot believe they are being this unreasonable. I am on my fourth car in five years. My second new M. I am on the phone with BMWNA now.

Looks like I wont be driving a F10 M5 in 2012 afterall...
That sucks, what was their reason for the refusal?

I don't know exactly how your consumer laws work but over here the liability rests with the selling dealer who have to sort things out with BMW, the selling dealer also attempted the repairs on mine.

I think you need to get legal advice.

I did not receive a reson other than the car was bought outside of the servicing BMWNA market, but in same region. Have subsequently learned that corporate has been made aware (why just now is beyond me).

I don't have any idea. I will be talking to my attorney tomorrow. Really a shame.

I believe they have lost a customer. And I have been a big believer in the product. Just don't understand that level of service from that expensive a vehicle.

It really should not take any more time already. Guy spent good $$ on a car that has just been a headache. They have to give him new car and lots of apologies at the very least. This is BMW fuck up not his

Well, BMWNA corporate called earlier. They are "investigating" the situation. Wanted to know why I declined their "goodwill offer" of payments and a waiver preventing a buyback from occuring. Politely told them when they could identify the problem (for sure) with my vehicle and offer a true fix, we could discuss that. Otherwise, wasn't interested in payments. Want a car that works.

They are discussing it at "the corporate level" and will get back to me today or tomorrow.

When I was having my problems it was quickly evident that BMWUK were only interested in repairing the car, you'll probably find the same with BMWNA.

Over here it is the selling dealer that is liable and only they can actually negotiate a new car with BMW, is it the same over the pond?

Thanks Mike. I love your new X5 BTW. Great color combo. Interested to see how you like your 20" all seasons work. If I ever get a car that works, then I might get a set...
