So much for being hopeful. Got call from dealer wanting to have the car to "look at". I asked why, and response was "so we can know your trade in value". At this point most of my reasoning left. I told him that this was absolutely ridiculous. I am not trading in the vehicle, it is defective, and I want a replacement. He said he would have to talk to his manager again. This is bullshit. I cannot believe this stuff. I am done. Lawyers can handle it.

Make sure you know why they want to see it. Might be for their own valuation. The dealer that a buyback is performed through has the option of retaining the vehicle to sell on their own. Or BMWNA sends it to auction. If the dealer wants it, they get it at a subsidized cost through BMWNA. They may want to see it just to get that part of the equation figured out, to see things like damage, smoker etc.

True...but I would just pass this to lawyers at this point. Too much crap going on, I can not imagine the headache this has been, not worth it. I would even sue their ass for your time at this point.

I am likely to sue for the time lost, and for the cost of litigation. As a physician, I despise having to use legal means, but I am just fed up.

Hoping to hear from BMWNA today.

So, apparently this was, in fact, a vehicle valuation to assess BMWNA's financial cost on the buyback. However, now they are saying there is a mileage usage fee that will be assessed on the buyback that I will be liable for. I have never heard of this. Per my conversation with BMWNA, this is a provision that allows BMWNA to "recoup" some of the cost of the vehicle buy back and varies from state to state. Any ideas on what I am looking at here?

Trust me, as a physician myself, I would be last person to suggest that, however, some people do not understand any other language. Whatever miles you put on the car, I doubt it was anymore than 1-2K, should be offset by the waste of your time you had to go through dealing with this headache. I would tell them you are happy to pay for the miles as long as they would pay you back for your professional time

So, valuation was done today. Everything finally appears to be on course for a buyback. Only glitch may be this mileage usage charge. They are wanting to charge me $3200 for the almost 16000 miles I have driven the care (well 14500 minus the miles they used). I think this is unreasonable. I know I am getting a new car from them, but I am getting a new car only because the one I have has a problem that can't be diagnosed or fixed. That is a problem inherit with the vehicle, not done because of my use of the vehicle. I have declined to pay it. So, we shall see what the final decision is on Monday.

For what its worth, they are charging me $.20 per mile driven. Same as any overage fee. I have a 15000 per year lease, and at 13 months am at 16300 minus the 1400 they drove. Am I being unreasonable?

Doesn't sound unreasonable to me.

Maybe you should suggest that the fee would be fine if they would accept an invoice for your time spent on this at your normal, professional rate per hour.
