Spoke with BMWNA and dealer today. I informed BMWNA that dealer had no vehicle in stock that I was interested in, most (i.e. 550i and 750i) are missing key options. There are several X5M/X6Ms in status 112, but this means I will likely be unable to alter them as they belong to other dealers and they haven't even asked if the dealers will trade. Mind you, all this info came from a sales rep after I had to call and ask.
BMWNA told me today that I "needed to make up my mind what I wanted". I told her, I have been clear. BMW has three options. Let me custom order a X5M, get me into a 550i MSport equipped the way I want, or turn me loose. At this juncture, and after my 4th BMW, I prefer option three. BMWNA have been very disrespectful of my time and money at this point. I was told by the NJ Corporate individual today that she had understood that the dealer was agreeing to wipe my lease out as long as I took an in stock vehicle, but that it was at the discretion of the regional manager. I have never been offered to walk away from my lease and into another one up to this point by anyone. I made 2 calls to the dealer today, to my point of contact the Service Manager, and no phone calls returned (I was told today was their Christmas party and he was in charge of it). So, I am still in limbo. Honestly, I am just fed up. I know these can take time, and I am not upset about waiting for another vehicle. I am mad because they keep pushing these "good faith payments" as an option, and make it sound like I am being unreasonable for not taking them. In reality, they want me to sign that waiver. I told her today, I wouldn't be asking for this type of resolution if they knew what was wrong, or how to fix the problem. However, after now a fourth time to the dealer, they still have no idea. So, why keep a problem plagued vehicle? I talked to two Porsche dealers. Both have equally equipped Turbo Cayennes hitting the ground in the next 2-4 weeks. I am probably leaving the BMW family. Makes me sad. I have always stated I would be a BMW customer for life, and up to this, had been treated very well by service/sales. However, this problem is not my fault, and I do not think I should have to "settle" for a vehicle other than what I originally ordered/wanted/ or could possibly satisfy that desire. I am aware that may sound spoiled, but that is not my intention. I am fortunate to be able to afford/drive a vehicle like I have. Sorry, rant over... J |

Sorry for your problems with the vehicle.
I wonder how much of the delay in resolution is due to there being three different states involved (selling dealer, licensing state, servicing dealer) and the fact that there are probably a multitude of managers at BMW who each have a piece of the problem, but with none of them fully owning the problem. It shouldn't matter, but I suspect that in the real world of geographic responsibilities, non-uniform lemon laws by state, and so on, it complicated the resolution path. I have always tried to buy from the dealer who will be doing the servicing, but I realize that isn't always possible. Good luck with the buy back.

Having been through all this I know how you feel and I hope they get you a new car, I felt exactly the same, would never touch another BMW etc but it all changed when I got the selling dealer principal on my side and he really did a good job.
In the end I was offered the car back plus $4000 compensation, a new in stock car or a new car built and a free loaner. I took the new car build, its a 14 week (about 10 weeks to go now) wait but they put me in a 2010 X6 to start with and last night swapped it for brand spanking new 2011 Alpine White X5 40D M Sport with delivery mileage on it. Whilst this has restored my faith in BMW they need to sort out their quality control and customer service, they are turning out too many high value vehicles with serious faults and taking far too long to resolve these problems. |

Just got a call from dealer in WV. They are now offering a trade in offer of $6000 off any vehicle in dealer inventory or at VPC, but will not wipe out my lease on my X5M. So, I told them I would consider that in addition to ordering a new X5M of my choosing, but only if my lease was absolved. Don't want to end up money out of pocket on something not my fault.

If you remember, we both received our trucks around the same time. Mine now has "the whine", and I am waiting to hear if there is a definite fix out there before I take it in to deal with the service dept.'s typical 2 day wait and BS. This is my 3rd M vehicle in 6 years. I would expect BMW to replace your truck. They don't seem to be able to fix it. I doubt you need them to get that discount off a vehicle already made. We shall see. I am open to the 550i MSport if they cant get me a build slot. I have a feeling they won't be able to get me one. I don't feel like there is any incentive to.

Just reading through some of this thread....Three observations....
1) Lemon Law should definitely apply, and should work in your favor. I do hope you are documenting everything including the dates, times, and names of the folks you are speaking to at the dealer and at BMW/NA. 2) Since said Lemon Law is on your side, contact an attorney immediately and have the attorney write a detailed letter to both the dealer and BMW Corporate, laying out their obligations under said law. In fact, you may be better off cutting off all contact with them and having your lawyer do all the talking for you. Explain to your lawyer exactly what you want, and then set him/her loose. You have to realize: for you this might be personal (as it would be for any of us). For corporations, NOTHING is personal. It's all business. But they REALLY sit up and take notice is when something is on LEGAL LETTERHEAD. They may very well change their tune when they see that you are on a legal warpath and that the law is on your side. 3) Automotive sales/service can be a dirty business. Not sure if BMW is any worse that any other car maker out there. They can all be pretty slimy and in a state of denial: Toyota, Honda, Ford, Porsche, Mercedes, etc. Occasionally, you may happen upon a decent enough Service Advisor or dealer, but even then I always keep them at "arm's length". They can pretend to be your best friend one day, and then turn on you the next. If you are certain about abandoning BMW for Porsche, that is certainly understandable considering the nightmare they have put you through. But be forewarned: you may be escaping from one devil straight into the arms of a different devil. And as the ol' saying goes: oftentimes the devil you know is better than the one you don't... |

StanF18 is absolutely correct that a legal letter goes straight to their in-house legal counsel who will review the situation and the aplicable state law. Lemon law attorneys often know the in-house counsel from many many claims filed and they will put the fire under BMW corporate to pay attention. Nobody wants to have to do this, but sometimes it's the only way to get a fair result, which is why we have consumer protection laws.

I heard from dealer today. Looks like this may be coming to conclusion. They have 4 build slots for X5Ms. The regional rep appears to have agreed to wipe out my lease and let me start anew. Will know for sure, and in writing, tomorrow. I am going to request to drive my vehicle till new one arrives.
