Just spoke with BMWNA. Nice chap helped me out. I basically have straight out asked for a replacement. They are researching the matter. They state to hopefully hear something back in the next 2-3 days.

Over here the contract is with the garage and not BMW, I don't know if it is different in the US but don't you need to get the dealer to replace it?

I would also put your case forward in writing rather than phone calls.

I am going to have a letter written from my attorney to BMW within the week.

The responsibility lies with BMWNA as they are the issuers of the original warranty.

Here the warranty also lies with BMW UK but the supply of faulty goods lies with the retailer (garage), if you want it replacing as they sold you a defective car isn't that the responsibility of the garage? The garage then sorts it out with BMW?

Well, I don't know if it is that clear cut. Short answer is that BMWNA ultimately decides to allow the buy back. So, I have taken the matter up with them directly. My dealer has also stated that if this fix doesn't resolve the issue, they would "personally" take it up with BMWNA to get a new vehicle. But, I don't want to wait 2-3 weeks to get the vehicle back, then only to have to return it yet again. I think this is most likely given that we don't have a clear cut reason for problem as of yet.

If that happens, it is another 4-5 weeks to likely get my replacement. So, I am looking at 6-8 weeks more. I just don't trust the vehicle. Period. Don't want to mess with it anymore.

So it sounds like the dealer will expect you to take the car back if they fix it this time, if you don't want that I think you should tell them straight now and in writing, might be worth getting legal advice first though but I wouldn't want it back.

Once mine had been given back 3 times as fixed when it wasn't that was it, there was no way I was going to accept that car and would have taken it through a court if I had to.

BMW needs to start looking after its customers a bit better and in good time or it won't have so many customers.

I was planning to order a 2011 X5M. After reading this thread I am having second thoughts. I had an E70 4.8i. It was very good and reasonably trouble free. Right now my summer car is in storage and I am roughing it with a 2007 328 touring.

There have only been about 4-5 cars, according to BMWNA, that have been effected by this. So, I don't think it is a wide spread issue. It is not effecting my decision to get a replacement X5M, which is what I want.

4-5 with this issue, half a dozen with the whiring, vanos issue with mine and this is only what we know about, how many Ms do they make a year, 200? This is a terrible percentage of cars with problems, if the Chevy Impala had a similar percentage you'd have 8000 cars with faults pro rata.

That said I am having a replacement but I doubt they would have given me the money back anyway, I am having to wait until March for my replacement so I'm roughing it in a 2010 X6 3.0D

There are well more than 200 a year made. Not sure of the numbers but my guess is maybe 5% of total annual production? Maybe 5K to 10K a year? Again this is just a guess. Remember people typically with perfect cars don't complain so if you were to add up all the unique people here that have had a serious issue. Myself included, though I do not consider the whining a serious issue as it never had any impact on the performance or usability of the car.. then I think you would be suprised to see how few the numbers are. Take that number multiply it by 20 for people having issues that don't subscribe or post to any thread and you would likley see the overall percentage is very small... Owning one I would never discourgae someone who was interested in one to look elsewhere. Bottom line it is a fabulous vehicle.
I feel for the people here that have had or are having issues as I was one of those at one time with another vehicle. I do know first hand how frustrating it is to not have your car. But at the same time we should not automatically conclude that they are all bad and not recommend them. Remember we need to sell these things someday....
