Having been through all this I know how you feel and I hope they get you a new car, I felt exactly the same, would never touch another BMW etc but it all changed when I got the selling dealer principal on my side and he really did a good job.

In the end I was offered the car back plus $4000 compensation, a new in stock car or a new car built and a free loaner. I took the new car build, its a 14 week (about 10 weeks to go now) wait but they put me in a 2010 X6 to start with and last night swapped it for brand spanking new 2011 Alpine White X5 40D M Sport with delivery mileage on it.

Whilst this has restored my faith in BMW they need to sort out their quality control and customer service, they are turning out too many high value vehicles with serious faults and taking far too long to resolve these problems.

We shall see. I am open to the 550i MSport if they cant get me a build slot. I have a feeling they won't be able to get me one. I don't feel like there is any incentive to.

Hopefully some news today.

Just reading through some of this thread....Three observations....

1) Lemon Law should definitely apply, and should work in your favor. I do hope you are documenting everything including the dates, times, and names of the folks you are speaking to at the dealer and at BMW/NA.

2) Since said Lemon Law is on your side, contact an attorney immediately and have the attorney write a detailed letter to both the dealer and BMW Corporate, laying out their obligations under said law. In fact, you may be better off cutting off all contact with them and having your lawyer do all the talking for you. Explain to your lawyer exactly what you want, and then set him/her loose. You have to realize: for you this might be personal (as it would be for any of us). For corporations, NOTHING is personal. It's all business. But they REALLY sit up and take notice is when something is on LEGAL LETTERHEAD. They may very well change their tune when they see that you are on a legal warpath and that the law is on your side.

3) Automotive sales/service can be a dirty business. Not sure if BMW is any worse that any other car maker out there. They can all be pretty slimy and in a state of denial: Toyota, Honda, Ford, Porsche, Mercedes, etc. Occasionally, you may happen upon a decent enough Service Advisor or dealer, but even then I always keep them at "arm's length". They can pretend to be your best friend one day, and then turn on you the next. If you are certain about abandoning BMW for Porsche, that is certainly understandable considering the nightmare they have put you through. But be forewarned: you may be escaping from one devil straight into the arms of a different devil. And as the ol' saying goes: oftentimes the devil you know is better than the one you don't...

+1. This is just business to them. They have put you in this position; you have been clear with your requests and they have not been receptive. Having been in your shoes with another car manufacturer, I know the frustration you are feeling, but you are not helping yourself at this point. It's time to stop being a victim and take charge of the situtation.

StanF18 is absolutely correct that a legal letter goes straight to their in-house legal counsel who will review the situation and the aplicable state law. Lemon law attorneys often know the in-house counsel from many many claims filed and they will put the fire under BMW corporate to pay attention.

Nobody wants to have to do this, but sometimes it's the only way to get a fair result, which is why we have consumer protection laws.

I heard from dealer today. Looks like this may be coming to conclusion. They have 4 build slots for X5Ms. The regional rep appears to have agreed to wipe out my lease and let me start anew. Will know for sure, and in writing, tomorrow. I am going to request to drive my vehicle till new one arrives.

All goes well, should have a new X5M by mid January. Will know tomorrow, but wont believe anything till in writing.

I have it all spec'd out for you so you don't have to worry

1. Alpine white/Black ventilated/comfort (you can pick the trim ) with all options except RES.

I'm in an Alpine white 40D M-Sport loaner, horrible colour for the X5 IMHO, Monte Carlo Blue / Silverstone for me.

I am going to probably do Alpine White, Bamboo full ventilated leather, all options except roof rails and RES (gonna mount iPads for both kids).
