Unacceptable. I had problems with my '09 and my dealer in Cinci really stepped up. I am not allowed to talk about it but suffice to say, I am not driving an X5 with any problems anymore. All this from a dealer I had never used. My first X5, an '05 4.8is was bought at "the store" (if this helps the OP). From my experience, it all depends on the dealer, as they go to bat for you. The dealer, overall, has been excellent. My only complaint lay in the phone call from Thursday, trying to pass the buck because of the fact that the car was purchased in one state, licensed in another, and the servicing dealer was in a third. This was all bunk, of course.

Other than that, they have been very good to me. I have had a BMW loaner at my disposal all this time, which is nice since the other closest dealer refused any service loaners.

So, we shall see what happens on Monday. Oh, and BTW, 2 more error lights since last posting.

BMWNA has, according to the regional rep involved, refused to replace the car.

They are stating that I either need to do one of the following:

1). Contact a dealer in KY (where I live and vehicle is registered).
2). Contact original selling dealer (in ATL).
3). Retain legal counsel.

I am beyond mad. I am likely through with BMW at this point. Cannot believe they are being this unreasonable. I am on my fourth car in five years. My second new M. I am on the phone with BMWNA now.

Looks like I wont be driving a F10 M5 in 2012 afterall...

That sucks, what was their reason for the refusal?

I don't know exactly how your consumer laws work but over here the liability rests with the selling dealer who have to sort things out with BMW, the selling dealer also attempted the repairs on mine.

I think you need to get legal advice.

I don't have any idea. I will be talking to my attorney tomorrow. Really a shame.

I believe they have lost a customer. And I have been a big believer in the product. Just don't understand that level of service from that expensive a vehicle.
